TWDB Board Meeting Agenda – February 2, 2023

Visitors wishing to speak before the Board should complete a visitor registration card and either attend the meeting in person or contact the Board via video conference. The Texas Open Meetings Act prohibits visitors from attending by phone only. The visitor registration card is available and should be completed and submitted by email to [email protected] or in person at the registration desk no later than 8:00 am on February 2, 2023.


1. Discussion of public relations and board activities.

2. Consider authorizing the Executive Administrator to exercise the option to renew the existing agreement with Hilltop Securities Inc. for a one-year term beginning March 1, 2023 at a cost of $980,000 and up to two additional one-year renewal options approve under the terms of the contract for an aggregate contract amount not exceeding $4.9 million. 3. Consider authorizing the Executive Administrator, the Chief Financial Officer, the General Counsel and the Development Fund Manager to take all actions necessary for the issue, sale and delivery of State of Texas Water Financial Assistance and Refunding Bonds in one or more series to seize; and approving the selection of financial advisors, bond advisors, disclosure advisors, senior managing underwriters and co-managing underwriters to negotiate the bonds. 5. Consider accepting and authorizing the issuance of amendments to 31 Texas Administrative Code ยง358.6 relating to water loss testing. (John Sutton) Board Agenda #05 Document

6. Consider accepting and approving the issuance of amendments and amendments to 31 Texas Administrative Code Chapters 363, 371 and 375 relating to the use of alternative project delivery methods for construction projects funded by the Texas Water Development Board. 7. Consider approving an application by the Greater Texoma Utility Authority by resolution approving amendments to outstanding bonds purchased by the Texas Water Development Board and delegating authority to the Executive Administrator and his staff to take any necessary action to facilitate the application. 8. Approve by resolution a request by Tri-Try Water Supply Corporation (Stonewall County) for $300,000 in equity relief from the Drinking Water State Revolving Fund for the planning, design and construction of a water system improvement project. (Tom Barnett) Board Agenda #08 Document

Approve by resolution a request from the City of Leonard, Fannin County for $5,696,000 in financial assistance consisting of $2,850,000 in funding and $2,846,000 in waiver from the Clean Water State Revolving Fund for planning , the design and construction of a project to improve the sewage system . 10. Approve by resolution a request from the City of Pasadena, Harris County for $10,999,860 in financial assistance consisting of $10,450,000 in funding and a $549,860 grant from the Flood Infrastructure Fund for planning, acquisition, design and construction a flood improvement project. 11. Consider amending previously passed Texas Water Development Board (TWDB) Resolution No. 21-017 by resolution, amended by TWDB Resolution No. 22-011, to include the Guadalupe-Blanco River Authority’s obligation for the extension of the Clean Water State Revolving Fund to change the commitment period. 12. The Board accepts comments from the public on all matters within the purview of the TWDB, except for matters subject to ex parte prohibition under Texas Government Code Section 2001.061.

13. The Board may adjourn to a Board meeting and hold a closed meeting to discuss any item on this agenda when a matter is raised which is appropriate for the Board to hold a private consultation with its counsel on a matter in which the duty of attorney rests with the governmental agency under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Texas Government Code. The Board of Directors may hold a closed meeting to seek legal advice and to discuss any pending or contemplated litigation, settlement offers, or the appointment, employment, evaluation, reassignment, duties, disciplinary action, or dismissal of certain Directors, including the Executive Administrator and General Counsel, as permitted by the Sections 551.071 and 551.074 of the Texas Open Meetings Act codified as Chapter 551 of the Texas Government Code. The Board may also meet in open session to take action on any legal or personnel matter being dealt with in closed session as required by Section 551.102 of the Open Meetings Act, Chapter 551 of the Government Code. The board of directors may hold a private meeting to discuss and discuss financial matters related to the investment or potential investment of the funds of the board of directors as permitted by Section 6.0601(a) of the Texas Water Code. The Board of Directors may also meet in open session to take action on financial matters discussed in closed session as required by Texas Water Code Section 6.0601(b).

The next currently scheduled meeting of the Texas Water Development Board will be on March 9, 2023. Additional meetings may be scheduled and will be published in accordance with the Texas Open Meetings Act.

This meeting is a public meeting pursuant to Chapter 551 of the Texas Government Code. Pursuant to Criminal Code Section 30.06 (Trespassing by License Holders with a Concealed Handgun), a person licensed under Subchapter H, Chapter 411, Government Code (Handgun License Act) shall not enter this property with a concealed handgun. Pursuant to Section 30.07 of the Criminal Code (Trespassing by License Holders with an openly carried handgun), a person licensed under Subchapter H, Chapter 411, Government Code (Handgun License Act) shall not enter this property with an openly carried handgun. For purposes of this notice, “Property” means the room or rooms where the public meeting of the Texas Water Development Board is held.
